RIGHTJOB EMPLOYER TERMS AND CONDITIONS

The term “employer” refers to direct employment campaigns from organisations.

The terms “recruiter” refers to any Agency engaged in conducting for profit employment campaigns.

1. YOUR ACCEPTANCE OF THIS AGREEMENT

This is an Agreement between you and all persons you represent (and for purposes of this Agreement, "person" includes natural persons and any type of incorporated or unincorporated entity) and the Career Transition Partnership (CTP), part of Right Management a Manpower Company and governs your use of the www.ctp.org.uk site and the content, information and services provided through the RightJob site contained within.

Each time you use the Website and RightJob you signify your acceptance and agreement, and the acceptance and agreement of all persons you represent, without limitation or qualification, to be bound by this Agreement, and you represent and warrant that you have the legal authority to agree to and accept this Agreement on behalf of yourself and all persons you represent. If you do not agree with each provision of this Agreement, or you are not authorized to agree to and accept this Agreement, you may not use the Website and RightJob.

2. SCOPE OF THIS AGREEMENT

This Agreement is in addition to and supplements any written agreements that you or any persons you represent have with the CTP.

This Agreement and all other agreements that you or any persons you represent have with the CTP (now or in the future) together constitute the entire agreement regarding your access to and use of the RightJob, and supersede all previous agreements (written, oral or otherwise) regarding your access to and use of RightJob. In the event of any inconsistency or conflict between the provisions of this Agreement and the provisions of any other agreement that you or any persons you represent have with CTP future), the provisions of this Agreement shall govern regarding your access to and use of the Website and RightJob

3. CHANGES TO THIS AGREEMENT

CTP may, in its discretion, change, supplement or amend this Agreement as it relates to your future use of the Website from time to time, for any reason, and without any prior notice or liability to you or any other person. You may not change, supplement, or amend this Agreement in any manner.

GENERAL

Please read these Terms and Conditions carefully before using our services. Your use of our site constitutes your acceptance of the terms and conditions. If you do not agree with all of the following terms and conditions, please do not use our site.

This service is provided by the Career Transition Partnership (CTP), part of Right Management, a Manpower Company, whose Job Bank system hereafter will be referred to as “RightJob”.

We reserve the right to change, modify or otherwise alter these terms and conditions at any time. Such changes and/or modifications shall become effective immediately upon the posting thereof. Continued use of our services will constitute your acceptance of revised terms and conditions. Please review the terms and conditions periodically.

RightJob allows users to search for and access the content of the site, CTP does not guarantee that the advertising services will lead to a successful advertising campaign for the employer.

SITE RULES

You agree that your use of RightJob is limited for the sole purpose of recruiting candidates or posting jobs for gainful employment. Your participation is subject to all applicable local, regional, national and international laws and regulations. If CTP determines that a registered employer, recruiter or any other user has violated the rules of our site, (as defined below) you will be notified by e-mail and your user registration will be immediately terminated.

User agrees NOT to:

  • Use RightJob for solicitation, advertising or offering of goods or services.
  • Disseminate content intended to harass or market to CTP’s clients and candidates.
  • Post Jobs that are fictitious in nature.
  • Use the service for the purposes of sending junk/spam email, chain letters, duplicative or unsolicited messages or "spamming" or in connection with contests, surveys, direct marketing, or pyramid schemes.
  • Use RightJob to gather CVs or candidate information for purposes other than to fill specific vacancies.
  • Register as an employer when engaged as a for profit Employment Agency

Violation of these terms will result in immediate termination of user account access, and prosecution as applicable.

TERM AND TERMINATION

Jobs posted on RightJob will remain live for 28 days or as agreed with the employer.

Content

At all times the employer or recruiter is responsible for the content of their advertisement. CTP will not be liable for checking the advertising content to ensure that it is correct, accurate, complete or that it does not contain errors. CTP is not liable for errors, mistakes of omissions made during the electronic submission, processing and/or posting of the advertising content.

Password

Employers and Recruiters are responsible for maintaining the confidentiality of their information and password. Employers and Recruiters are responsible for all uses, whether or not authorized by them. Employers and Recruiters agree to immediately notify the CTP of any unauthorized use of your registration or password.

Responses to Advertisement

Employers and Recruiters agree to deal fairly and professionally with individuals who may respond to an advertisement posted and not do anything which may bring CTP into disrepute. Employers and Recruiters will indemnify us from and against any claim brought by an individual against CTP arising from their breach of this obligation or any other of these terms and conditions.

The Employer/Recruiter will endeavour to notify the CTP of successful hires as soon as practicable following acceptance by the Service leaver. They should include confirmation of the job title, start date and salary (if disclosed).

CTP does not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is the Employers’ and Recruiters’ responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.

Employers and Recruiters need to be aware that this job bank system operates as a venue. The tools provided by CTP for use in the employer’s assessment of the suitability or otherwise of any particular candidate or advertised vacancy are to assist in taking these steps, but are not intended as a substitute.

This means that we do not:

  • obtain sufficient information for a potential Employer or Recruiter to select a suitable Service leaver for the position which they seeks to fill;
  • obtain confirmation from the Service leaver that they have the experience, training, qualifications or authorisation to work in the position to be filled or that they wish to undertake the role to be filled;
  • take any steps to ensure the Service leaver and Employer or Recruiter are each aware of any requirement imposed by law or otherwise which must be satisfied by either of them to permit the Service leaver to fulfil the position to be filled;
  • take any steps to ensure that it would not be detrimental to the interests of the Employer or the Recruiter for the Service leaver to fulfil the position to be fulfilled;
  • take up any references in relation to a Service Leaver; or
  • make any arrangements for accommodation of the Service Leaver.

It is recommended that, if you are an Employer or Recruiter, to ensure a Service Leaver’s suitability for the role.

As an employer these could include checking the identity of the Service Leaver and that the Service Leaver has the experience, training, qualifications and authorisation required by law or otherwise for the position and whether there are any requirements imposed by law or otherwise to meet to enable a Service Leaver to take up a position.

In addition, where professional qualifications are required or where Service Leavers are to work with vulnerable persons or children, employers should obtain copies of the relevant qualifications or authorisation, obtain at least two references from people who are not relatives of the Service Leaver and undertake a criminal records bureau check.

ERRORS

CTP endeavours to provide accurate information through the Website. Nevertheless, errors may occur. Accordingly, CTP reserves the right to change other information available through the Website at any time and from time to time without any notice or liability to you or any other person.

THE CTP WILL NOT UNDER ANY CIRCUMSTANCES BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY LOSS OF USE, LOSS OF PRODUCTION, LOSS OF INCOME OR PROFITS (ANTICIPATED OR OTHERWISE), LOSS OF MARKETS, ECONOMIC LOSS, SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE OR EXEMPLARY OR PUNITIVE DAMAGES, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, ARISING FROM, CONNECTED WITH, OR RELATING TO THE USE OF THE WEBSITE BY YOU OR ANY OTHER PERSON, AND REGARDLESS OF ANY NEGLIGENCE OR OTHER FAULT OR WRONGDOING BY CTP

WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL MANPOWER OR ANY OF THE AFFILIATES' AND PROVIDERS' TOTAL LIABILITY TO YOU OR ANY OTHER PERSON FOR ANY CLAIMS, PROCEEDINGS, LIABILITIES, OBLIGATIONS, DAMAGES, LOSSES, AND COSTS, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR UNDER ANY OTHER THEORY OF LAW OR EQUITY, AND REGARDLESS OF ANY NEGLIGENCE OR OTHER FAULT OR WRONGDOING BY CTP OR ANY AFFILIATE OR PROVIDER OR ANY PERSON FOR WHOM CTP OR ANY AFFILIATE OR PROVIDER IS RESPONSIBLE, EXCEED £100 (UK) OR THE AMOUNT YOU PAID TO CTP FOR THE USE OF THE WEBSITE, WHICHEVER IS LESS.

The limitation of certain liabilities is prohibited by legislation in some jurisdictions. Such legislative limitations may apply to you.

RELEASE

YOU HEREBY RELEASE, REMISE AND FOREVER DISCHARGE EACH OF MANPOWER AND THE AFFILIATES AND PROVIDERS AND ALL OF THEIR RESPECTIVE FRANCHISEES, PARTNERS, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, INFORMATION PROVIDERS, SERVICE PROVIDERS, SUPPLIERS, SUBCONTRACTORS, LICENSORS AND LICENSEES, AND ALL OTHER RELATED, ASSOCIATED, OR CONNECTED PERSONS FROM ANY AND ALL MANNER OF RIGHTS, CLAIMS, COMPLAINTS, DEMANDS, CAUSES OF ACTION, PROCEEDINGS, LIABILITIES, OBLIGATIONS, LEGAL FEES, COSTS, AND DISBURSEMENTS OF ANY NATURE AND KIND WHATSOEVER AND HOWSOEVER ARISING, WHETHER KNOWN OR UNKNOWN, WHICH NOW OR HEREAFTER EXIST, WHICH ARISE FROM, RELATE TO, OR ARE CONNECTED WITH YOUR USE OF THE WEBSITE.

INDEMNITY

YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS THE CTP AND ALL OF THEIR RESPECTIVE, PARTNERS, AGENTS, DIRECTORS, OFFICERS, EMPLOYEES, INFORMATION PROVIDERS, SERVICE PROVIDERS, SUPPLIERS, SUBCONTRACTORS, LICENSORS AND LICENSEES, AND ALL OTHER RELATED, ASSOCIATED, OR CONNECTED PERSONS (COLLECTIVELY, THE "INDEMNIFIED PARTIES") HARMLESS FROM AND AGAINST ANY AND ALL LIABILITIES, EXPENSES AND COSTS, INCLUDING WITHOUT LIMITATION REASONABLE LEGAL FEES AND EXPENSES, INCURRED BY THE INDEMNIFIED PARTIES IN CONNECTION WITH ANY CLAIM OR DEMAND ARISING OUT OF, RELATED TO, OR CONNECTED WITH YOUR USE OF THE WEBSITE OR YOUR BREACH OF THIS AGREEMENT. YOU WILL ASSIST AND COOPERATE AS FULLY AS REASONABLY REQUIRED BY THE INDEMNIFIED PARTIES IN THE DEFENSE OF ANY CLAIM OR DEMAND. ADVICE AND INFORMATION PROVIDED BY MANPOWER OR THE AFFILIATES AND PROVIDERS OR THEIR RESPECTIVE REPRESENTATIVES, WHETHER ORAL OR WRITTEN, WILL NOT CREATE ANY REPRESENTATION, WARRANTY OR CONDITION OR VARY OR AMEND THIS AGREEMENT, INCLUDING THE ABOVE DISCLAIMER, LIABILITY EXCLUSION, LIABILITY LIMITATION, RELEASE AND INDEMNITY PROVISIONS, AND YOU MAY NOT RELY UPON ANY SUCH ADVICE OR INFORMATION.

FAIR ALLOCATION OF RISK AND LIABILITY.

YOU ACKNOWLEDGE AND AGREE THIS AGREEMENT REPRESENTS A FAIR ALLOCATION OF RISK AND LIABILITY.
